Terms and conditions, often referred to as T&Cs or terms of service, are a set of rules, guidelines and legal agreements that set out the basis on which a business will provide goods or services to its customers or users. T&Cs establish the rights, responsibilities and obligations of both the provider and the user or customer.

Terms and conditions can be a minefield if you aren’t sure what you need. A key thing for businesses needing terms and conditions to bear in mind, is to ensure that they are clear, comprehensive and written in plain language. Here are our top tips for getting your terms and conditions right:

  1. Clear and concise language: use clear and straightforward language that is easily understandable by your target audience. Avoid using complex legal jargon or overly complicated sentences. The goal is to communicate the terms and conditions effectively to users without causing confusion.
  2. Comprehensive coverage: make sure your terms and conditions cover all the necessary aspects relevant to your business and the services or products you provide. This will vary depending on your business so terms and conditions will usually be quite bespoke.
  3. Seek legal advice: consulting with a legal professional experienced in drafting terms and conditions can help ensure that your document complies with relevant laws and regulations. They can also provide guidance on specific clauses or considerations that may be unique to your industry or business.
  4. Highlight important sections: consider using headings, subheadings or bullet points to make the terms and conditions easier to navigate. This allows users to quickly find the sections that are most relevant to their concern or interest.
  5. Keep them accessible: make your terms and conditions readily accessible to users. This can be done by prominently displaying a link to them on your website, app or other platforms where your products or services are offered. Alternatively, place them on the reverse or any order form you might use, or simply send them to your customer by email when they initially engage you. Users should be able to review the terms and conditions before making a purchase or engaging with your business.
  6. Regularly review and update: laws and regulations can change over time and your business may evolve. It is important to review your terms and conditions periodically and update them as needed to ensure they remain accurate, relevant and legally compliant.
