Non-Means, Non-Merits Tested Legal Aid

Legal aid is granted automatically in some cases, regardless of financial circumstances or the strength of the case. This applies to:

  • Care Proceedings – Legal aid is automatically available for the child at the centre of the proceedings, as well as for their parents or anyone with parental responsibility.

  • Adoption and Children Act 2002 (Chapter 3, Part 1) – Applications for placement orders and recovery orders.
  • High Court Cases (Inherent Jurisdiction) – Including wardship proceedings.
  • Private Law Children Act Cases – Child arrangement orders, prohibited steps orders, specific issue orders, parental responsibility orders, and special guardianship orders.
  • Family Law Act 1996 Cases – Applications for non-molestation orders or occupation orders

We apply for legal aid
