The role of employers in preventing industrial diseases

Our client worked as a lead caster. He began experiencing symptoms such as headaches, tiredness, pain in the stomach, and weight loss. These symptoms were later diagnosed as lead poisoning, which forced him to take time off work.

According to the guidance published in 2023 by the Health & Safety Executive employers must review their work processes to reduce workers exposure to lead. This can be achieved by having appropriate control systems in place including extraction systems and respiratory protection.
We filed a claim against our clients’ employer, arguing that the company’s extraction system was defective and that he was not provided with adequate respiratory protection. The company initially denied the claim and blamed the client for not wearing personal protective equipment.
Shortly before a preliminary hearing concerning our clients’ case, the company made an appropriate settlement offer which he accepted.
This case highlights the importance of employers ensuring a safe working environment. Stephen added: “Companies can reduce exposure to poisonous substances including lead by making sure that the appropriate protective equipment is provided. Companies must also take care to ensure that their ventilation systems are suitable and regularly maintained.
“By following these guidelines, employers can significantly decrease the risk of lead poisoning and other occupational diseases, safeguarding the health and well-being of their employees.”
