Compensation secured for injuries caused by excessive lifting
By Stephen Bradley-Watson
Many jobs involve some degree of lifting or manual handling, but it's crucial for employers to ensure that employees are not required to undertake excessive lifting or manual handling tasks. Such work can lead to significant injuries, impacting workers' physical wellbeing and their ability to perform everyday tasks.
Research by the Health and Safety Executive , referenced by the Industrial Injuries Advisory Council , estimated that from 2004 to 2005, 375,000 people in the UK suffered significant work-related injuries to the upper limbs or neck.
Stephen Bradley Watson , a specialist industrial disease solicitor, recently represented a claimant who worked as a lorry driver for a flour manufacturing company based in Essex, for 17 years. The claimant was required to lift and carry bags of flour weighing between 16 kg and 25 kg, in and out of customers' premises and up and down stairs at various locations.
As a result of his work, he suffered an aggravation injury to his shoulder, which required surgery and led to significant time off work. After various delaying tactics, the defendant agreed to pay £25,000 in compensation to the claimant, in settlement of his claim. Our client expressed his satisfaction, stating, "I think Mr. Bradley-Watson did a brilliant job."
Stephen commented: “It's important that employers recognise the dangers and severe injuries which can be caused by excessive manual handling. Lessons need to be learnt that risk assessments and procedures have to be put in place to ensure that no employee is required to undertake excessive lifting at work.”
